Ayron Thelen
The widow of an Isabella County man killed when a commercial truck driver ran a stop sign has filed a lawsuit against the driver and his employer.
Meanwhile, Ayron Thelen’s mother, Mystie Beckwith, hopes to get legislators to enact harsher penalties for drivers who cause fatal accidents.
Cassandra Thelen’s attorney, Thomas W. Waun, filed the suit Jan. 23 in Isabella County Trial Court against Rock Bottom Stone Supply, asking for in excess of $25,000 for damages in connection with Ayron Thelen’s death Nov. 9 when Foster Dennis Boshans ran a stop sign at Drew and Coldwater roads in Sherman Township.
Boshens, whom Isabella County Prosecutor David Barberi charged earlier this week with a moving violation causing death, is scheduled to be in Chief Judge Eric Janes’ Mt. Pleasant courtroom Oct. 8 at 10:30 a.m. for a final pre-trial conference.
He is scheduled to be arraigned on the criminal charge, a one-year misdemeanor, Sept. 6 at 9:15 a.m. by Magistrate Aaron W. Miller.
Since the crash, Boshens lost his commercial driver’s license, and is disqualified from obtaining one in the future, according to the Michigan Secretary of State.
A driving assessment completed by the secretary of state indicates that Boshens’ CDL was initially suspended, followed by an indefinite suspension in January.
Boshens was also involved in a traffic crash in Flint in May 2022 and another in June 2018, according to SOS records.
He has been ticketed for speeding in Stanton and Roscommon County, according to the SOS.
Those moving violations can’t be used against Boshens in the criminal case, but they show a pattern of possibly distracted driving that could cause another fatal crash, Beckwith said.
Beckwith and her family are disappointed that Boshens isn’t facing a tougher punishment.
While there is a negligent homicide charge in Michigan, Beckwith said she knows Barberi’s burden of proof would be difficult to prove because Boshens was not under the influence of alcohol at the time of the crash and was not speeding.
Still, she wants a change that will allow for justice for the loved ones of fatal crash victims.
