HAYS COUNTY, Texas (KEYE) — A Tom Green Elementary School teacher has filed a lawsuit in connection to last month’s deadly Hays CISD school bus crash in Texas that killed a 5-year-old and a Texas doctoral student.
“Of all the 25 years of cases I’ve brought for families where hiring practices have hurt people, this is the worst by far,” said trial Attorney Sean Breen.
The lawsuit states the teacher, Deborah Serna, was severely injured in the crash. She broke at least four bones in her back and will be out of work for the time being.
Serna is seeking over $1 million in monetary relief to cover the incurred expenses for medical care and the future expenses for such medical needs.
“The level of negligence and gross negligence by the Defendants in this case truly shocks the conscience,” the lawsuit says.
Breen adds it’s atrocious that the suspect, Jerry Hernandez, was able to drive a weapon of a truck on the road. He also notes that Hernandez’s mugshot was used for his work ID picture at F.J.M. Concrete, LLC.
On Friday, March 22, an FJM Concrete Pumping truck driven by 42-year-old Jerry Hernandez was traveling east on State Highway 21 when it veered into the path of the school bus and two other vehicles following behind and struck the front of the bus, causing it to spin counterclockwise and roll.
Hernandez admitted he only got three hours of sleep the night before and consumed cocaine the morning of the collision, according to court documents.
Pre-K student Ulises Rodriguez Montoya and 33-year-old Ryan Wallace, who was traveling behind the bus, died at the scene.
