BASTROP COUNTY, Texas (KXAN) — A group of victims from the deadly crash involving a Hays CISD school bus and a concrete pump truck filed a lawsuit Tuesday against the truck driver and truck company.
The new lawsuit from “the most severely injured survivors” alleges the parties responsible for the crash “reflect a larger problem within our community,” according to attorney Jason Feltoon, who is representing seven students and one parent from the crash.
The plaintiffs are asking for over $1 million, according to the lawsuit filed in Bastrop County.
KXAN has reached out to legal representation for Jerry Hernandez, Francisco Martinez and FJM Concrete for comments. This article will be updated if a response is received.
This is the latest lawsuit the truck driver, truck company owner and truck company are facing. Other lawsuits were filed by a preschool teacher aboard the bus and the mother of a child who was on the bus.
The March 22 crash happened after a concrete pump truck driven by Jerry Hernandez veered into the lane of a Hays CISD school bus, causing the bus to roll. Five-year-old Ulises Rodriguez Montoya, who was on the bus, and 33-year-old Ryan Wallace, who was driving behind the bus, were killed in the crash.
“We will shine a spotlight on an institutional failure that cost families and our community the lives of two individuals with great promise and bright futures,” a statement from Feltoon said.
Hernandez was arrested on a warrant of criminally negligent homicide. He admitted to smoking marijuana the night before the crash and using cocaine the morning of the crash, according to an arrest affidavit.
