The ice cream truck driver who plowed through the living room wall of a Kenner apartment, fatally injuring a 12-year-old boy, was sentenced to probation Wednesday after pleading guilty to negligent homicide, according to court officials.
Judge Lee Faulkner of the 24th Judicial District Court deferred a five-year prison sentence for 73-year-old Mechaul Mansoor, instead ordering him to serve three years of active probation.
Mansoor admitted his responsibility in the death of Javier Adrian Flores Fajardo, known as Adrian to friends and family. The boy was playing video games inside his first-floor apartment in the 300 block of Clemson Drive in Kenner on May 20 when the crash occurred, Kenner police said.
Mansoor’s ice cream truck was seen speeding in the moments before the wreck, barreling through a stop sign at the intersection of Clemson Drive and Dartmouth Place. The truck then crashed through the wall, trapping the boy, authorities said.
It took firefighters 10 minutes to free Adrian. But he suffered severe injuries, including a skull fracture, police said. He was hospitalized for six days before his family made the decision to donate his organs.
The maximum penalty for a negligent homicide conviction is five years in prison.
